How to start a roofing business in Nebraska

Nebraska has no state roofing licence. What catches roofers here is the Insured Homeowners Protection Act, which applies to any residential job paid from insurance proceeds and carries a three day cancellation right, a ban on rebating the deductible, and a notice that must be set in fourteen point type. Omaha adds a Class E licence. The rest, in order, is below.

    Register the entity with the Secretary of State

    A Certificate of Organization for an LLC is $100 filed online, $110 in office, and the filing office acts on electronic submissions within one to two business days. Nebraska identifies the form by name, not by a form number. A sole proprietor trading under anything other than their own name registers a trade name instead, at the same $100 and $110.

    Publish the notice, which Nebraska still requires

    Nebraska is one of the few states that still makes new LLCs publish. The notice runs three successive weeks in a legal newspaper of general circulation near the designated office, and the proof of publication is then filed with the Secretary of State for $25 online or $30 in office. The newspaper sets its own rate for the notice itself. A trade name follows a different rule: published once, in the city or village where the business sits, with the proof filed free within forty-five days or the registration is cancelled.

    Register as a contractor with the Department of Labor

    Roofing is construction work, so the Contractor Registration Act applies once you earn $5,000 a year or more from it. The fee rose to $40 on 1 August 2026, and LB847 waives it entirely for a self employed operator paying under $3,000 a year in wages, stated under oath. You elect your sales tax contractor option on this same application, and the election is public in the Contractor Registration Database.

    Get the EIN, then register for tax

    The EIN is free from the IRS and usually issued the same day online. Nebraska tax registration is the Nebraska Tax Application, Form 20, revised June 2026, and the form states no application fee. Register before the first taxable sale, and read the tax section below carefully first, because which of your services are taxable is the part of this trade people get wrong.

    Fix the estimate template before the first storm job

    The Insured Homeowners Protection Act reaches any residential contractor doing roof system work, other exterior work, or interior and exterior cleanup on one to four family property paid from insurance proceeds. Every written contract, repair estimate and work order has to carry a specified notice in capitalized fourteen point type, signed by the insured and sent to the insurer before proceeds are paid. The homeowner can cancel until midnight on the third business day after the later of signing or receiving written notice that the claim is not fully covered, and you tender back all payments within ten days. You may not promise to rebate any part of the deductible, including as a discount on your own fee.

    Be careful about who negotiates the claim

    Nebraska licenses public adjusters under a separate act, and the Department of Insurance describes a public adjuster as someone who negotiates a claim settlement on the policyholder's behalf. There is no Nebraska statute that expressly bars a roofer from negotiating a claim, and the widely repeated assertion that there is appears to be unsupported. What is clear is that a resident public adjuster licence carries a $50 application fee, an exam, a $20,000 surety bond and an in state office. Where the line sits for your own practices is a question for an attorney licensed in Nebraska.

    Sort workers' compensation from the first hire

    The Workers' Compensation Act applies to every resident employer who employs one or more employees in the regular trade or business. That means the first hire, not the fifth. Owners are outside it unless they elect in, in writing, filed with the insurer. Willful failure is a Class I misdemeanour, carries civil penalties of up to $1,000 per violation with each day counted separately, and exposes members personally. Nebraska does not require general liability insurance by statute; commercial and municipal contracts are what require it in practice.

    Check the truck and trailer against 10,000 lbs, not 26,000

    Nebraska applies the federal motor carrier rules to intrastate carriers over 10,000 lbs gross combination weight, which a three-quarter ton truck and a loaded trailer will normally exceed. That means a USDOT number obtained before operations begin, the number displayed on both sides, driver qualification files, medical cards, Nebraska intrastate hours of service and annual inspections. It does not mean a CDL, which starts at 26,001 lbs, and it does not mean apportioned plates for a carrier working only in Nebraska.

    Price off the burdened rate before quoting anything

    Take a wage and add payroll tax, workers' compensation at the roofing class code, insurance, the truck and the hours nobody pays you for. Roofing carries one of the highest comp rates of any trade, which is why a rate borrowed from a landscaping crew will not survive contact with a real job.

The reroof is not taxable. The cleanup is.

Roofing is construction contractor work, so the labor has not been taxable since October 2007 and the materials are handled through whichever option you elected. Storm work is where it splits, because the same truck on the same day is doing two things Nebraska taxes differently.

One invoice line turns the whole job taxable

Revenue applies the same rule across trades: the exempt portion of an invoice must be separately stated from the taxable portion, or the total amount charged for all portions is subject to tax. Bill a tear off, a reroof and a debris cleanup as one number and the cleanup rule swallows the entire invoice. Under Option 1 the same trap applies to materials and labor billed together.

What most sources get wrong about Nebraska

These are the points where the widely repeated answer is out of date or borrowed from another state. Each one is checked against the primary source.

The $40 contractor registration fee is waived for most solo operators. LB847 took effect on 18 July 2026 and added a new subsection to the fee statute: a contractor pays no fee if they are self-employed and pay no more than three thousand dollars a year to employ other people, stated under oath on the application. Registration itself is still required. Almost nothing online mentions this, and plenty of pages still quote the old $25 fee, including one Department of Revenue FAQ page that contradicts the Department of Labor guidance document.

Omaha's Class E is a city licence, not a county one. Roofing industry pages routinely describe it as a Douglas County requirement. It is issued by City of Omaha Planning, Permits and Inspections, and it reaches three miles past the city limits, which catches operators who assume they are outside the line.

The intrastate USDOT threshold is 10,000 lbs, not 26,001. Nebraska statute applies the motor carrier regulations to intrastate vehicles over ten thousand pounds, and the State Patrol truck guide says the same in plain words. Compliance sites routinely publish 26,001, which is the CDL threshold. A loaded roofing rig sits in the gap between the two.

Paying an unregistered subcontractor means withholding 5%. A contractor who pays a subcontractor that is not listed in the Contractor Registration Database must withhold five percent of every payment and remit it as income tax withholding, reported on Form 941N and Form W-3N. Project owners and homeowners are exempt from this. It catches people the first time they put a second crew on a job.
